 Information clause 

for self-employed persons 



 

  1. Pursuant to Article 13(1) and (2) and Article 14(1) and (2) of the General Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), this is to inform you that: The controller of your personal data is Zakłady Tłuszczowe Bielmar sp. z o.o. with its registered office in Bielsko-Biała at ul. Sempołowskiej 63 43-300 Bielsko-Biała. 
     
  2. Your personal data will be processed pursuant to:
     

- Article 6(1)(b) of the GDPR for the purpose of: 
✓ performing agreements concluded, 
✓ handling settlements between the parties, 
✓ accounting for marketing activities – accounting for services performed 

- Article 6(1)(c) of the GDPR for the purpose of: 
✓ fulfilling legal obligations in the field of accounting under tax regulations, in particular the Tax Ordinance, the Corporate Tax Act and the Value Added Tax Act 

- Article 6(1)(f) of the GDPR – a legitimate interest pursued by the controller, which consists in: 
✓ pursuing communication regarding the performance of the agreement for the duration of cooperation, 
✓ analysing business performance and preparing forecasts for effective sale of products, 
✓ conducting open source intelligence for business partners, 
✓ verifying the trade credit limit granted to you on an ongoing basis in order to make a decision on cooperation with deferred payments, 
✓ performing the rights and obligations arising from the business relationship confirmed by the Agreement and possibly other understandings or agreements, 
✓ settling/verifying remuneration for the services specified in Agreements and understandings and promotional and marketing contracts specified in the Agreements, 
✓ checking the correct performance of the services specified in the Agreement, 
✓ asserting claims and defending the Controller's rights in the event of possible disputes, including debt recovery. 
 

  1. The categories of personal data processed from sources other than directly from you may include, in particular: 
    NIP (Tax ID), company name, address, REGON (Business ID) PKD (Classification of Business Activity), the granting of and expiry date of a trade credit limit, information in public registers and from publicly available sources. 
     
  2. Your personal data may be made available to third parties only if the Controller is authorised or obliged to do so by law. The recipients of your data may be, in particular, persons operating the Controller's infrastructure or IT systems, subcontractors, persons providing services related to the execution or improvement of the sales process (e.g. payment intermediaries, banks, advertising agencies, couriers or carriers), as well as advisors (e.g. for accounting or legal services) or auditors. The Controller may also transfer your personal data to debt collection agencies under duly concluded agreements and in accordance with the Controller's instructions. 
     
  3. Your personal data collected not directly from you come from our business partners, the recipient of our receivables analysis service and from publicly available sources. 
     
  4. The provision of your personal data to the extent necessary for the performance of the agreements concluded and for the settlement of accounts between the parties is mandatory; otherwise, it is voluntary. 
     
  5. Your data may be transferred to a third country. In this case, your data will be secured in the manner required by generally applicable law, in particular through the use of standard contractual clauses (SCC) as referred to in Article 46 of the GDPR. 
     
  6. Your data will be stored for no longer than necessary, i.e. for no longer than the period prescribed by law (for statistical or tax purposes) or the statute of limitations for the Controller’s claims, if any. 
     
  7. You have the right to request from the Controller access to and rectification or erasure of personal data or restriction of processing concerning you as well as the right to data portability; 
     
  8. In addition, you also have the right to object to further data processing. 
     
  9. If the processing is carried out in violation of the law, the data subject has the right to lodge a complaint with the supervisory authority, the President of the Office for Personal Data Protection.   10. Your data will not be processed by automated means including profiling.

Complaints 




Pursuant to Article 13(1) and (2) and Article 14(1) and (2) of the General Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), this is to inform you that: 
 

  1. The controller of your personal data is Zakłady Tłuszczowe Bielmar sp. z o.o. with its registered office in Bielsko-Biała at ul. Sempołowskiej 63 43-300 Bielsko-Biała. 
     
  2. The personal data obtained in connection with your complaint about products of Zakłady Tłuszczowe Bielmar sp. z o.o. will be processed for the following purposes: 

 

  1. taking action to consider and process your complaint, including telephone or e-mail contact to investigate the matter, making settlement proposals, etc, 
  2. responding to your letters, requests and complaints, 
  3. responding to pending proceedings, including before the consumer ombudsman. 

 

  1.  The legal basis for the processing of your data as a result of submitting and considering a complaint about products of Zakłady Tłuszczowe Bielmar sp. z o.o. is as follows: 

 

  1. performance of contractual obligations related to liability for defects, verification of reported complaints (Article 6(1)(b) of the GDPR, 
  2. provisions of the Civil Code relating to warranty for defects of goods, quality guarantees and Article 74(2)(6) of the Accounting Act (Article 6(1)(c) of the GDPR), 
  3. necessity for purposes arising from the Controller's legitimate interests pursued by properly handling complaints, controlling the correctness of the complaint procedure and defending the Company's interests (Article 6(1)(f) of the GDPR). 

 

  1. In connection with the complaint procedure, we will process your personal data such as your name, contact address indicated in the complaint, e-mail address and telephone number. 
    Providing the above-mentioned personal data is voluntary, but failure to do so may result in the refusal to process your complaint. 
     
  2. If a complaint is made through a distributor, the source of your personal data is the information provided by the distributor. 
     
  3. Your personal data may be made available to third parties only if the Controller is authorised or obliged to do so by law. The recipients of your data may be, in particular, persons operating the Controller's infrastructure or IT systems, subcontractors, persons providing services related to complaint processing (e.g. payment intermediaries, banks, couriers or carriers), as well as advisors (e.g. for legal services) or auditors. 
     
  4. Your data may be transferred to a third country. The transfer of data outside the territory of the European Economic Area will take place pursuant to Article 26(2) and (4) of Directive 95/46/EC in conjunction with Article 46(5) of the GDPR, using additional safeguards in the form of standard data protection clauses adopted by the European Commission. 
     
  5. Your personal data will be processed for the period necessary to fulfil the aforementioned purposes, taking into account the term of the agreement, the warranty period, the periods of limitation of claims under warranty and quality guarantee, as well as the storage periods specified in separate regulations, including accounting regulations, and the period necessary to defend the interests of the Company, but no longer than for a period of 6 years. 
     
  6. You have the right to access your data, the right to rectification and erasure of your data, the right to restriction of processing and the right to data portability; 
     
  7. If the processing is carried out in violation of the law, the data subject has the right to lodge a complaint with the supervisory authority, the President of the Office for Personal Data Protection.
